Abstract

The Western Front has become, once again, and after 100 years, an important and increasingly popular tourist destination. The Centenary is already encouraging large numbers of visitors to engage with this highly poignant landscape of war and to commemorate the sacrifice and loss of a previous generation. Interest is also being sharpened in the ‘places of war’ as battle-sites, trench-systems, bunkers and mine craters gain a clearer identity as war heritage. For the first time this book brings together the three strands of heritage, landscape and tourism to provide a fresh understanding of the multi-layered nature of the Western Front. The book approaches the area as a rich dynamic landscape which can be viewed in a startling variety of ways: historically, materially, culturally, and perceptually. To illustrate these two dominant interpretations of the region’s landscape – commemorative and heritage – are highlighted and their relationship to tourism explored. Tourism is a lens through which these layers can be peeled away, and each understood and interacted with according to the individual’s own knowledge, motivation, and degree of emotional engagement. Tourism is not regarded here as a passive phenomenon, but as an active agent that can determine, dictate and inscribe this evocative landscape. The Western Front: Landscape, Tourism and Heritage is a timely addition to our increasing interest in the First World War and the places where it was fought. Abstract

The French projet d'ordonnance, which reformed contract law, the general regime of obligations and the proof of obligations appeared in February 2015. One year later, in February 2016, the final version of the ordonnance was published. The ordonnance thoroughly reforms French contract law and the law of obligations and will enter into force in October 2016.This book results from the Contract Law Workshop of the 20th Ius Commune Conference held 26-27 November 2015. The theme of this Workshop was: 'The French Contract Law Reform: a Source of Inspiration?' Since the conference in November 2015, all authors have incorporated comments on the final version of the ordonnance. Whereas Van Loock briefly sketches the antecedents and the outcome of the reform, the other authors each tackle specific topics of the reform that surprised and/or excited the legal community. Pannebakker tackles the precontractual phase and assesses the attractiveness of the reform for international commercial transactions. Peeraer gives a critical overview of the doctrine of nullity in the ordonnance. Leone explores the potential impact of the 'significant imbalance' test in the new ordonnance on employment contracts. In their contributions, Lutzi and Oosterhuis discuss the much-debated provision that introduces the theory of imprévision. The contributions by Jansen and Verkempinck are both focused on remedies: the newly introduced price reduction remedy and damages. Storme criticises the new rules on set-off in the ordonnance, and Mahé addresses the question why the final version of the ordonnance omitted the issue of interpersonal effects of fundamental rights on contractual freedom.

Abstract

Les journaux de la vie littéraire participent de la grande entreprise biographique du XIXe siècle qui a voulu faire vivre la littérature au quotidien en l’incarnant dans des auteurs de chair, personnages de plus en plus médiatisés à un moment où le champ littéraire gagnait en autonomie. Les Goncourt créent une forme nouvelle, héritière des mémoires, en écrivant leur fameux journal qui allait susciter tant de vocations de diaristes chez les hôtes du Grenier. Désormais la vie littéraire se reflète dans le kaléidoscope des journaux qui évoquent cénacles et réseaux avec leurs rites et leurs conversations, et qui croquent les portraits des grands et petits artistes contemporains. Les journaux d’une époque tissent entre eux de constantes, subtiles et passionnantes correspondances. Ce volume les fait se répondre, nous faisant entendre les voix alternées des Goncourt, de Rosny, Descaves, Primoli, Régnier, Matthieu Galey et Brenner. Les journaux prennent des formes plus ou moins abouties : cahiers, simples carnets de notes, journaux qui cultivent le style naturel ou l’écriture artiste. À côté des journaux devenus des classiques, nombre de témoignages essentiels restent encore à l’état de manuscrits. Cet ouvrage a voulu présenter plusieurs de ces grands textes non publiés et en donner des extraits significatifs : journaux de Descaves, de Rosny, de Maury, de Primoli, de Romain Rolland. L’étude de ces vastes corpus permet de dégager une poétique du journal de la vie littéraire. Ces œuvres ont manifestement un intérêt esthétique qui ne doit pas faire oublier leur valeur documentaire pour des historiens de la littérature ou des représentations. Témoignage sur la vie littéraire, le journal est aussi une fantasmagorie, où réapparaissent les acteurs d’un monde disparu refaçonné par un diariste démiurge au gré de ses fantasmes.

Abstract

Les Examens environnementaux de l’OCDE sont des évaluations indépendantes des progrès accomplis par les pays pour tenir leurs objectifs environnementaux. Ces examens sont destinés à favoriser les échanges de bonnes pratiques, à aider les gouvernements à rendre compte de leurs politiques et à améliorer la performance environnementale, individuelle et collective, des pays. Les analyses s’appuient sur un large éventail de données économiques et environnementales. Au cours de chaque cycle d’examens environnementaux, l’OCDE passe en revue l’ensemble de ses pays membres ainsi que certains pays partenaires. Les derniers pays examinés sont le Brésil (2015), les Pays-Bas (2015) et le Chili (2016). Ce rapport est le troisième examen environnemental de la France. Il évalue ses progrès en matière de développement durable et de croissance verte, avec un accent particulier sur la transition énergétique et la biodiversité.

Abstract

This book provides a systematic analysis of the innovations that occurred in the display of royal power during John II’s four years in English captivity. Neil Murphy shows how the French king’s competition with Edward III led to a revolution in the presentation of the royal image, manifesting through developments to the sacral character of the French monarchy, lavish displays of gift giving, and the use of courtly display. Showing that the Hundred Years War was not just fought on the battlefields of France, this book unravels how the war played out daily in the competition for status between Edward III and John II. Neil Murphy is Senior Lecturer in History at Northumbria University, UK.

"À l'été 2008, la planète tremble en découvrant l'ampleur de la crise financière. Les subprimes deviennent en quelques semaines une réalité dévastatrice. Peut-on considérer que l'échec a eu une vertu et que du séisme est sorti un bien? Sans doute, mais à quel prix? Success story, demande de régulation, crise, faillite, échec, tels sont les axes d'une réflexion à laquelle l'Association française d'histoire économique (AFHÉ) a voulu participer à l'occasion de son dernier congrès, les 4 et 5 octobre 2013. Les travaux présentés dans cet ouvrage font varier les échelles d'analyse temporelle, spatiale et sociale et révèlent les multiples dimensions de l'échec, puisque celui des uns forge parfois le succès des autres et peut avoir des retombées imprévisibles, pas nécessairement négatives, que l'on se place au niveau des individus, des familles, des sociétés ou de l'humanité tout entière. Lorsque pointe l'échec, plusieurs options s'ouvrent : c'est l'heure des choix. Faut-il opter pour une gestion prudente? Réorienter l'activité et se faire plus offensif ou au contraire abandonner un créneau, un projet? Renoncer, persévérer, recréer? L'échec peut alimenter le repli et le conservatisme autant que l'innovation et la prise de risques. Si la remise en cause est une vertu possible de l'échec, quels en sont les lieux et les outils? On trouvera ici vingt-quatre interventions inédites organisées en cinq thèmes qui rendent compte de la richesse des approches : les usages sociaux de la faillite ; l'histoire des entreprises ; les espaces transfrontaliers et politiques en Europe ; les districts et les territoires ; les institutions et les politiques publiques.
